About these terms
These terms apply when you play a game published by Shadow Development ("we", "us"), including The Great Expanse, or use this website. Shadow Development is an independent game studio and registered business in Australia. By playing our games or using this website, you agree to these terms.
If you got the game from the Apple App Store or Google Play, that store's terms (such as Apple's Licensed Application End User License Agreement or the Google Play Terms of Service) also apply. If those terms and ours conflict over the store's own role, the store's terms win.
Your licence to play
We give you a personal, non-exclusive, non-transferable licence to download and play our games for your own non-commercial use, on devices you own or control, as allowed by the store you got them from.
Please don't copy, sell, rent, redistribute or modify our games, and don't decompile or reverse engineer them except as far as the law allows. Don't use our games for anything unlawful.
Purchases
Our games are free to play and may offer an optional one-off in-app purchase (in The Great Expanse, the Full Version). The price is shown in the store before you buy. Payments, receipts and refunds are handled by Apple or Google under their own policies, so please contact them about refunds.
A purchase is tied to your store account. If you reinstall the game or move to a new device using the same store account, use the game's restore option to get it back.
Your save data
Your progress is saved on your device, not on our servers. If you uninstall the game, clear its data or lose your device, your progress may be lost unless your device has backed it up. We can't recover saves we never received.
Our content
Our games, this website and everything in them (code, art, music, writing, characters and logos) belong to Shadow Development or are used under licence. "Shadow Development", "The Great Expanse" and their logos are names and marks of Shadow Development. Third-party components such as fonts and the game engine are used under their own licences, which are credited in the games.
You're welcome to stream and share videos and screenshots of our games, including on channels that earn money, as long as you don't suggest that we endorse you.
Updates and availability
We may update our games to fix problems, add content or rebalance gameplay, and that can change how things work. We'll try to keep our games available and working on supported devices, but we can't promise they'll run on every device or be available forever.
Australian Consumer Law
Our games come with guarantees that can't be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law or any other law that can't lawfully be excluded. If you live outside Australia, you may also have rights under your local consumer law that these terms don't affect.
Liability
As far as the law allows, we aren't liable for indirect or consequential loss, or for loss caused by things outside our reasonable control. Where the law allows us to limit our liability for failing to meet a consumer guarantee, our liability is limited to supplying the services again or paying the cost of having them supplied again.
This website
This website is for information. Screenshots and descriptions of games in development show work in progress and may change before release. Links to other websites are provided for convenience, and we aren't responsible for their content.
Governing law
These terms are governed by the laws in force in Australia, and you and we submit to the non-exclusive jurisdiction of Australian courts.
